This Acceptable Use Policy forms part of our Terms and Conditions, and governs your access to and use of our website at hylark.com(the Website), and the use of, and registration with, our life management tool offered through our Website (our Services).
Unless otherwise stated, You means the user of the Website and/or the Services.
Unless otherwise defined herein, terms shall have the same meaning as in the Terms.
In the event of a breach of this Acceptable Use Policy, we reserve the right to take any action which we consider necessary to protect ourselves, our Website and Services, and other users, including (a) suspend or terminate Accounts, or (b) disable access to the Services.
You agree that you will not, whether yourself or in conjunction with anyone else:
(a) use or access the Services or the Website in contravention of any applicable laws or engage in deceptive activities;
(b) use the Services in a way that would interfere with, disrupt, or negatively affect the peaceful use of other users, including by distributing a virus or other harmful code;
(c) infringe any third party’s right, including intellectual property rights;
(d) use or attempt to use another person’s Account without their authorisation;
(e) pose as another person or entity;
(f) use our Services to transmit malware or host phishing pages, or perform any activities (including uploading content) that harm or disrupt the operation of the Services or other of our infrastructures, or Third Party Services;
(g) use any bots, data mining, spider, crawler, scraper, script, browser extension, offline reader, or other automated means or interface not authorised by us to access or interact with the Website and/or the Services, including to extract data or modify the rendering of Website or Services pages or functionality;
(h) you are probe, scan, or test the vulnerability of any system or network or breaching or circumventing any security or authentication measure;
(i) use the Services or access our Website in a way that could impair the functioning of or otherwise damage or overburden our Services and/or Website;
(j) reverse engineer, decompile, disassemble or decode any part of the Website or our Services or do anything to seek access to source code bypass, attempt to or circumvent any protection we put in place to protect our Services and Website;

In addition, you will not and will not encourage others to, upload, transmit or use the Services or any Customer Data that:
(a) may involve child sexual exploitations;
(b) promotes suicide or self-harm, incites hate or violence against others;
(c) is offensive, or promotes discrimination based on race, sex, religion, national origin, physical ability, sexual orientation or age;
(d) infringes on third parties’ intellectual property rights;
(e) contains personal data of third parties without their prior written consent, or otherwise than in accordance with applicable data protection laws;
(f) is obscene, including pornographic content (including material rated R+18, home porn and hardcore material), indecent, vulgar, profane, harmful, harassing, threatening, embarrassing, malicious, abusive, menacing, defamatory, untrue or political; or
(g) is in breach of any law, statute, regulation or bylaw of any applicable jurisdiction.
